State of California sues EPA over tailpipe emissions
The State of California sued the EPA over failing to act on a tailpipe emissions waiver request. Fourteen other states will join California in the suit as interveners including Massachusetts, New York, Arizona, Connecticut, Illinois, Maine, Maryland, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, Washington and Pennsylvania. California Air Resources Board filed the waiver on December 21, 2005 and six months ago they warned they would sue. And in an astonishingly selfless and surprising move, the electric utilities backed California suing the EPA to force automakers to lower CO2 emissions.

When asked why electric utilities that contribute more CO2 emissions than autos would throw the auto industry under the bus...they replied "hey...we reduce CO2 output considerably via rolling blackouts."
